problem with tag module

We are experience a problem with the tag module. When one of our tags matches exactly any url title from a web log entry, then the system uses an incorrect template on the tag search results and breaks our design. We have found that just renaming the url title fixes the problem, or changing the tag, but we have a lot of weblog and a lot of tags, so this is becoming a major problem.
Has anyone else seen this, did we implement something incorrectly?

I found the error occurring in core expression engine code, version 1.6.4

I have no idea what is calling the eval statement that makes this happen.
We can’t upgrade right now due to sheer volume of data and sites, any chance you can point me to a way to update the code myself to prevent the error?
